GENERAL TERMS & CONDITIONS:

These terms and conditions affect your legal rights.  It is important that you read this agreement carefully before making a purchase.

Clip N Climb Edm Ltd (745512889) (known as “Clip 'n Climb Edmonton”) as the supplier of recreational services, sells all tickets and supplies all recreational services and facilities to the customer (“you”), including but not limited to: climbing, lessons, entertainment, food & drinks, function rooms and use of the Clip 'n Climb climbing arena within the Clip 'n Climb Edmonton venue.  All use of the facilities at Clip 'n Climb Edmonton is undertaken according to the Terms and Conditions in this agreement, the safety rules and restriction guidelines on the Clip 'n Climb Edmonton website and the instructions given during safety briefings. By purchasing a climbing session and/or participation in a session at Clip 'n Climb Edmonton, you are deemed to have accepted the Terms and Conditions in this agreement and signed the online Waiver Statement with Clip 'n Climb Edmonton. 

PARTICIPATION STATEMENT:

By participating you agree to the Terms & Conditions and Safety Rules & Restriction Guidelines below. You should be in good health to participate in physical activity and participate in accordance with these rules. It is the parent’s/guardian’s responsibility to ensure that their children adhere to these safety rules. Climbing is not recommended for guests that have neck or back problems, heart problems or have had recent surgery. If you are pregnant, you are not permitted to climb. If you encounter any problems or have any pre-existing medical conditions please discuss these with a staff member of Clip 'n Climb Edmonton.

DISCLAIMER:

By agreeing to these Terms and Conditions, you acknowledge that climbing has inherent risks and hazards and as a consequence personal injury and sometimes death can occur and you assume and accept all such risks. Clip 'n Climb Edmonton has taken every possible step to ensure that you have a completely safe and fun experience through the use of the automatic belay devices, the belay mate connector mechanism, high quality harnesses and the employment of a qualified and experienced team. However, we cannot accept any responsibility for injuries sustained due to negligence on the part of the participants. For you to enter the arena, we will require that you confirm that you accept responsibility for you and your party during your time in the Clip 'n Climb Edmonton climbing arena.

Real World Statement: Any physical activity carries an inherent risk of bumps and bruises and minor injury. By participating, or allowing others in your care to participate, you acknowledge and accept this risk.

RELEASE:

Subject to the provisions in this agreement, you release, discharge and forever hold harmless Clip 'n Climb Edmonton, its employees, directors and agents from all liability, obligation and responsibility of any nature for death or for any losses, damages or injuries relating to or arising directly or indirectly from your engagement in the recreational activity and from your participation in any related or incidental activities.

This Release shall be binding on your Estate and may be pleaded by Clip 'n Climb Edmonton as a complete bar in relation to any action, suit, claim or demand of any nature that you may bring against Clip 'n Climb Edmonton or which may be brought on your behalf. This Release shall extend and shall apply to all conduct of Clip 'n Climb Edmonton including, without limitation, the circumstances where the facilities pursuant to which the recreational activity takes place were not supplied with due care and skill or not fit for purpose or because of negligence, breach of contract, statute or statutory duty by Clip 'n Climb Edmonton. In no event shall Clip 'n Climb Edmonton be liable for loss of profit or consequential damages, whether based on breaches of contract, warranty or otherwise. 

GENERAL GUIDELINES:

Entry price includes the hire of the safety equipment, a safety briefing and demonstration, then a 1 hour climbing session.

(Please arrive 15 minutes prior to your booked session for check-in, harnessing and your safety briefing).

Participants must be a minimum of 4 years of age with a minimum weight of 30lbs to use the climbing equipment and wall structures at Clip 'n Climb Edmonton.

Parents/Guardians remain responsible for their child’s welfare at all times.

All climbers are required to have a valid Clip 'n Climb Edmonton online waiver form completed. Clip 'n Climb Edmonton allows children/youth aged 13-17 to be independently present at Clip 'n Climb Edmonton premises by themselves, but require a parent to sign the online waiver form on their behalf before the climbing session starts.


Please note: children aged under 13 must be accompanied by a responsible adult who is to remain onsite during the climbing session. Unaccompanied children will not be allowed to climb and will lose their booked session. If one parent or responsible adult is bringing multiple kids, some of which are not his/her own, that adult is responsible for that group.

All bookings are subject to our Booking/Cancellation/Refund Policy stated in these Terms and Conditions.

Participants must follow the below Safety Rules and Restriction Guidelines:

CLIMBERS MUST

  • Climbers must have a colour coded session wrist band before entering the climbing arena.

  • Climbers must wear a Clip 'n Climb harness at all times when inside the climbing arena.

  • Climbers must attend a Safety Briefing before climbing.

  • Climbers must always be clipped to the auto belay before climbing.

  • Climbers must follow Staff instructions, Safety Rules and Restrictions at all times.

  • Climbers must tie long hair back and no loose jewellery is to be worn. Eyewear to be secured.

  • Climbers must wear clean, closed toe shoes and comfortable clothing.

CLIMBERS MUST NOT

  • Climbers must not eat, chew gum or drink in the climbing arena (water permitted).

  • Climbers must not run, jump or push each other in the climbing arena.

  • Climbers must not hold onto or pull down on the safety rope whilst climbing.

  • Climbers must not bounce out from the wall during descent.

  • Climbers must ensure there is only one climber per wall.

  • Climbers must not be pregnant, impaired by a medical condition or are wearing a cast.

  • Climbers must not wear skirts or dresses, sandals, high heels or climb barefooted.

  • Climbers must not consume alcohol before or during their climbing session.

FEES, CHARGES AND TICKETS/PASSES:

All transactions are in Canadian Dollars (GST additional).  Fees and charges are shown on the Clip 'n Climb Edmonton website and at the venue and are subject to change without notice.  Booking online in advance is recommended to ensure space is available.  You are required to pay the session fee in full prior to being admitted into that session.  Tickets/passes issued remain the property of Clip 'n Climb Edmonton and are void if tampered with.  All Clip 'n Climb Edmonton tickets/passes are valid only for the date and time shown and may not, without the prior written consent of Clip 'n Climb Edmonton, be resold or offered for resale at a premium or used for advertising, promotion or other commercial purposes either by you as the original purchaser or any subsequent bearer.

You acknowledge that despite Clip 'n Climb Edmonton’s reasonable precautions, Clip 'n Climb Edmonton products and services may be listed at an incorrect price, with incorrect information, or which are unavailable due to an error or oversight.  In these circumstances, Clip 'n Climb Edmonton reserves the right to cancel the transaction, notwithstanding that your booking has been confirmed and your credit card has been charged. 

BOOKING / CANCELLATION / REFUND / DAMAGES  POLICY:

GENERAL ADMISSION/STANDARD (1 hour) BOOKINGS:

At Clip 'n Climb Edmonton, a standard (1 hour) booking can be rescheduled or cancelled (with refund) if sufficient notice is given. Should you need to cancel or reschedule your booking for whatever reason, we will require a minimum of 48 hour notice prior to your booked time. If less than 48 hours notice is given, we can offer rescheduling only, no refund. Rescheduling is always subject to availability.

CORPORATE EVENTS / EXCLUSIVE HIRE / GROUP / PARTY / SCHOOL BOOKINGS:

Party Package bookings require a deposit at the time of booking. Should you need to cancel your booking for whatever reason, we will need a minimum of 7 days notice for you to qualify for a refund. If less than 7 days notice is given, we will retain a $60 cancellation fee. Corporate events/Exclusive-Hire bookings usually have higher than usual contact with administrative staff, so please advise us with as much advance notice if significant changes, rescheduling or cancellation is required. We reserve the right to retain a cancellation fee should cancellation occur within 7 days of the booked event.

DAMAGE TO CLIP 'N CLIMB EDMONTON PROPERTY:

We reserve the right to charge you a fee for compensation if damage is willfully or unintentionally made by you, your group or a person in your care, whilst inside the Clip 'n Climb Edmonton premises. Clip 'n Climb Edmonton will assess the immediate damage and determine if the repair can be done in-house, or if a 3rd party contractor will be required to return the item or area to an undamaged state, or if a replacement item is needed. You will be informed of this process. Party bookings: All party room tables, cupboards, chairs and walls are assessed and cleaned as soon as a group exits the party room. You assume responsibility for the care of Clip 'n Climb property upon your entry into Clip 'n Climb premises and/or into a party room.

AGE RESTRICTIONS:

Children should be at least 4 years of age with a minimum weight of 30lbs to use the climbing structures at Clip 'n Climb Edmonton.

Children aged under 13 must be supervised by a responsible adult (over 18). The adult responsible for such children agrees to be bound by these General Terms and Conditions on their behalf and will directly supervise the child/children at all times. 

HEALTH AND EMERGENCY TREATMENT: 

You acknowledge and are aware that the physical and mental exertion required to engage in the recreational activity and/or to participate in the activity can activate or aggravate a pre-existing physical condition, so you are required to be in good health and free from any adverse medical conditions. You are not permitted to participate in climbing if you are pregnant, impaired by a medical condition or are wearing a cast.  You should seek medical advice if you are in doubt about your health. You agree to pay the cost of and authorise Clip 'n Climb Edmonton to take all steps it considers reasonably necessary to protect your welfare in the event of personal injury, including the administration of any emergency medical treatment and ambulance transportation. 

HEALTH AND SAFETY REGULATION:

Actions of Others: You acknowledge that that there are inherent risks that may arise from the actions of other participants and/or spectators that are not condoned by Clip 'n Climb Edmonton, but which may nevertheless still occur, which include pedestrian traffic, irresponsible, unreasonable, excessive, reckless, careless, unkind, wanton and generally objectionable behaviour whether intentional or unintentional.  

RIGHT TO REFUSE ENTRY: 

Clip 'n Climb Edmonton holds the right to refuse entry or cancel your access to use the facility if you:

  • reasonably appear to be under the influence or in the possession of alcohol, cannabis or illicit substances;

  • fail to comply with Safety Rules and Restriction Guidelines and/or fail to follow the instructions of Clip 'n Climb Edmonton staff;

  • behave in an offensive, reckless, careless or threatening manner to other customers or staff; and

  • are reasonably deemed to be a danger to yourself, other customers or Clip 'n Climb Edmonton staff.

CONSENT FOR VIDEO, IMAGES AND EMAIL: 

You acknowledge and give consent that, upon entering the Clip 'n Climb Edmonton premises, you and the children for whom you are responsible, may be photographed and/or videoed for security, safety and promotional purposes. Official Clip 'n Climb promotional photography will always be notified by signage upon entry at the Centre or advised in person whilst in the climbing arena. You also acknowledge that you may appear in the background of other people's personal videos and photos, which may/may not be shared on social media platforms.

By providing your email address to Clip 'n Climb Edmonton when making an online booking, you consent to receiving promotional and advertising material, specific to Clip ‘n Climb Edmonton, from time to time. We will not sell your personal information.
